Terms of Service
Last updated: August 4, 2026
1. Scope and Provider
These Terms of Service (hereinafter "Terms") apply to all contracts concerning the use of the Artist4Friends platform (hereinafter "Platform" or "Service") between
BotExplode UG (haftungsbeschränkt)
Kleinstückenweg 7i, 15806 Zossen, Germany
Managing Director: Paul Rybka
Registered at Amtsgericht Potsdam, HRB 33319 P
Email: hey@artist4friends.com
(hereinafter "Provider" or "we")
and the respective user (hereinafter "User" or "Artist").
By registering, the User accepts these Terms in the version valid at the time of registration. Deviating, conflicting, or supplementary terms of the User do not become part of the contract unless the Provider expressly agrees to their validity in text form.
These Terms apply to consumers (Section 13 German Civil Code, BGB) and businesses (Section 14 BGB). Where individual provisions apply to only one of these groups, this is expressly indicated.
2. Service Description
Artist4Friends is a software-as-a-service platform for artists, DJs, and event organizers to manage:
- Events and shows
- Guest lists and online registrations via public sign-up pages
- Digital tickets with QR codes
2.1 Free Usage
The free version includes in particular:
- Creation and management of a limited number of events
- A limited number of guests per event
- Basic guest list features
The current limits of the free version are displayed on the Platform's pricing page. There is no entitlement to free usage; the Provider may adjust the scope of the free version with effect for the future.
2.2 Pro Subscription
The paid Pro subscription additionally includes in particular:
- Unlimited events
- Unlimited guests per event
- Digital tickets with QR codes
- Export functions (e.g., CSV)
- Advanced statistics and settings
The service description on the pricing page at the time of ordering is decisive.
2.3 Further Development
The Provider continuously develops the Platform. The Provider may change or supplement features, provided that the core of the contractually agreed services is not restricted and the change is reasonable for the User, taking their interests into account.
3. Conclusion of Contract and Registration
The presentation of the Platform does not constitute a binding offer. By submitting the registration form, the User makes an offer to conclude a usage contract. The contract is concluded upon confirmation of the email address (double opt-in) and activation of the account.
A Pro subscription is concluded via the order process within the Platform. The subscription contract is concluded upon completion of the payment process. The contract text is not stored separately; these Terms are available on the Platform at any time.
Registration is only permitted for natural persons with full legal capacity as well as legal entities and partnerships. Minors may not register. As a rule, only one account per person or company is permitted.
4. User Account and User Obligations
The User agrees to:
- provide truthful and complete information during registration and in the billing profile, and keep it up to date
- keep their login credentials confidential and protect them from access by third parties
- inform the Provider immediately if there are indications of misuse of their account
- not transfer their account to third parties or allow third parties to use it
When using the Platform, the User is in particular prohibited from:
- using the Platform for illegal purposes or posting illegal, offensive, discriminatory, violence-glorifying, or pornographic content
- infringing the rights of third parties, in particular copyrights, trademarks, name rights, and personality rights (e.g., in uploaded images)
- technically attacking, overloading, or manipulating the Platform, or circumventing security mechanisms
- performing automated queries, scraping, or mass registrations without prior permission
- using guest list sign-up pages to collect data for purposes other than managing the guest list of the advertised event
- sending spam or unsolicited advertising via the Platform or using data collected through the Platform
In the event of violations of these Terms, the Provider is entitled — after a warning, or in serious cases without warning — to remove content, temporarily suspend the account, or terminate the contract for cause. Further claims remain reserved.
5. Guest Data and Data Processing Agreement
5.1 User's Responsibility
If the User collects personal data of guests via the Platform (e.g., via public sign-up pages), the User is the controller within the meaning of Art. 4(7) GDPR for this data. The User ensures that guest data is collected and used in accordance with applicable data protection laws, in particular that the User:
- transparently informs guests about the processing of their data
- uses the data exclusively for managing the guest list of the respective event
- does not send advertising to guests without an appropriate legal basis
- fulfills guests' data subject rights (access, deletion, etc.)
5.2 Processing by the Provider
The Provider processes guest data as a processor pursuant to Art. 28 GDPR, exclusively for the performance of the contractual services and according to the User's documented instructions resulting from the use of the Platform's features. The following data processing agreement additionally applies:
- Subject matter and duration: hosting and processing of guest data for the duration of the usage contract
- Nature and purpose: storage, display, confirmation, and deletion of guest list registrations and sending of related emails and tickets
- Data categories: name, email address, accompanying persons, registration status, timestamps
- Data subjects: guests of the User's events
- Confidentiality: persons authorized to process data are bound to confidentiality
- Security: the Provider implements technical and organizational measures pursuant to Art. 32 GDPR (see Privacy Policy)
- Sub-processors: the Provider uses the sub-processors named in the Privacy Policy (hosting, email delivery); the Provider will inform the User of intended changes, and the User may object for good cause
- Support and deletion: the Provider supports the User in fulfilling data subject rights and deletes guest data after the end of the contract or in accordance with the periods stated in the Privacy Policy
6. Prices and Payment Terms
6.1 Prices
The current prices for the Pro subscription are displayed on the Platform's pricing page. Unless stated otherwise, all prices include the applicable statutory VAT.
6.2 Payment Processing
Payment processing is handled by the payment service provider Stripe (Stripe Payments Europe, Ltd., Ireland). Stripe's terms additionally apply. Payment is due upon conclusion of the contract or at the beginning of each billing period and is collected via the payment method provided by the User.
6.3 Late Payment
If a debit fails, the User will be notified and the payment retried. If payment is still not received despite a reminder, the Provider is entitled to suspend Pro access until payment is received and to terminate the contract in accordance with statutory provisions.
6.4 Price Changes
Price changes apply only to future billing periods. They will be announced to the User in text form at least six weeks before taking effect. In the event of a price increase, the User has a special right of termination effective as of the date the increase takes effect.
7. Term, Renewal, and Termination
7.1 Free Account
The contract for free usage runs for an indefinite period and may be terminated by either party at any time without notice. The User may delete their account at any time in the settings or by email.
7.2 Pro Subscription
- Monthly subscription: term of one month; automatically renews for one further month unless canceled before the end of the current period.
- Annual subscription: term of one year; automatically renews for one further year unless canceled before the end of the current period.
Cancellation is possible at any time with effect at the end of the current billing period — via the subscription management in the Platform or by email to hey@artist4friends.com. After cancellation, Pro access remains active until the end of the paid period; already paid fees are not refunded pro rata, unless mandatory law provides otherwise.
7.3 Consequences of Ending the Pro Subscription
After the Pro subscription ends, the account is switched to the free version. The limits of the free version then apply again; events exceeding those limits remain stored but may no longer be fully usable. Pro features (e.g., export, tickets) are no longer available.
7.4 Termination for Cause
The right of both parties to terminate for good cause remains unaffected.
7.5 Data Deletion After End of Contract
Upon deletion of the account, the associated events and guest data are deleted, unless statutory retention obligations apply. The User is responsible for backing up any required data (e.g., via export) before deletion.
8. Right of Withdrawal for Consumers
Consumers (Section 13 BGB) have a statutory right of withdrawal when concluding a paid subscription, in accordance with the following instructions:
Withdrawal Instructions
Right of Withdrawal
You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period is fourteen days from the day of the conclusion of the contract.
To exercise your right of withdrawal, you must inform us (BotExplode UG (haftungsbeschränkt), Kleinstückenweg 7i, 15806 Zossen, Germany, email: hey@artist4friends.com) of your decision to withdraw from this contract by an unequivocal statement (e.g., an email). You may use the attached model withdrawal form, but it is not obligatory.
To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.
Effects of Withdrawal
If you withdraw from this contract, we shall reimburse to you all payments received from you without undue delay and in any event not later than fourteen days from the day on which we are informed about your decision to withdraw from this contract. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement.
If you requested that the services begin during the withdrawal period, you shall pay us an amount which is in proportion to what has been provided until you have communicated to us your withdrawal from this contract, in comparison with the full coverage of the contract.
Model Withdrawal Form
(If you want to withdraw from the contract, please fill out this form and send it back.)
To: BotExplode UG (haftungsbeschränkt), Kleinstückenweg 7i, 15806 Zossen, Germany, email: hey@artist4friends.com
I/we (*) hereby withdraw from the contract concluded by me/us (*) for the provision of the
following service: Artist4Friends Pro subscription
Ordered on (*)/received on (*): __________
Name of consumer(s): __________
Address of consumer(s): __________
Signature of consumer(s) (only for paper notification): __________
Date: __________
(*) Delete as appropriate.
For a contract for the provision of services, the right of withdrawal expires early if we have fully performed the service and only began performing the service after you gave your express consent and simultaneously confirmed your knowledge that you lose your right of withdrawal upon full performance of the contract by us.
9. Rights to Content
If the User uploads content to the Platform (e.g., event images, texts, logos), the User grants the Provider the simple, non-exclusive, geographically unlimited right to store this content for the duration of the contract, to process it technically (e.g., scaling), and to make it publicly accessible within the scope of the Platform's features (e.g., on the event's public sign-up page). No further rights are granted.
The User warrants that they hold the necessary rights to the uploaded content. The User shall indemnify the Provider against third-party claims based on a culpable breach of this warranty, including reasonable costs of legal defense.
10. Availability and Maintenance
The Provider strives for high availability of the Platform but does not owe uninterrupted accessibility. Excluded from availability are periods during which the Platform is unavailable due to scheduled maintenance (announced where possible and scheduled during low-usage times), force majeure, or other causes not attributable to the Provider.
11. Liability
The Provider is liable without limitation for intent and gross negligence, for culpable injury to life, body, or health, under the German Product Liability Act, and within the scope of any guarantee assumed.
In the event of a slightly negligent breach of essential contractual obligations (cardinal obligations, i.e., obligations whose fulfillment makes the proper performance of the contract possible in the first place and on whose observance the User may regularly rely), liability is limited to the foreseeable damage typical for the contract. In all other respects, liability for slight negligence is excluded.
The Provider performs regular backups but does not guarantee complete recoverability of data in every individual case. Export functions are available to the User for backing up their own data.
The respective User is responsible for content posted on the Platform (e.g., event descriptions, images). The Provider does not adopt this content as its own.
12. Changes to These Terms
The Provider may change these Terms with effect for the future, insofar as this is necessary due to changes in the legal situation, case law, technical framework conditions, or the further development of the Platform, and the change does not unreasonably disadvantage the User. Essential service obligations are not restricted thereby.
Changes will be communicated to the User in text form (e.g., by email) at least six weeks before they take effect. If the User does not object within six weeks of receiving the notification, the amended Terms are deemed accepted; the notification will separately point out this consequence, the right to object, and the right to terminate. If the User objects, either party may terminate the contract effective as of the date the change takes effect.
13. Dispute Resolution
The European Commission provides a platform for online dispute resolution (ODR): https://ec.europa.eu/consumers/odr. We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board within the meaning of the German VSBG.
14. Final Provisions
The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers, this choice of law applies only insofar as it does not deprive them of the protection of mandatory provisions of the law of the state of their habitual residence.
If the User is a merchant, a legal entity under public law, or a special fund under public law, the exclusive place of jurisdiction for all disputes arising from this contract is the Provider's registered office.
Should individual provisions of these Terms be or become invalid in whole or in part, the validity of the remaining provisions remains unaffected.
